Leave to appeal granted to the prosecutor in a criminal matter concerning hatred against a group of persons

The Supreme Court granted the prosecutor leave to appeal in a criminal matter concerning hatred against a group of persons on the grounds of sexual orientation. One of the defendants is a member of the parliament Ms Päivi Räsänen.

According to the first and second charge, in her written statement Räsänen insulted homosexuals as a group on the grounds of sexual orientation and another defendant published the written statement on the internet. According to the third charge, Räsänen published an opinion on her social media accounts and insulted homosexuals as a group on the grounds of sexual orientation.

The prosecutor did not appeal the dismissed fourth charge concerning Räsänen’s statements on a radio programme. Therefore the Supreme Court will not consider this charge.

Helsinki District Court dismissed all charges. Helsinki Court of Appeal upheld the decision.
